How is child support determined?
Parents are required to support their children financially in the Commonwealth of Virginia. Child support determinations can be made by Order of the Juvenile and Domestic Relations District Courts, the Circuit Courts, or by agreement of the parties. When a Court determines the issue of child support, it must consider all of the evidence relevant to the individual case. However, there is a rebuttable presumption in Virginia that the amount of the award that would result from the application of the guidelines set forth in the Virginia statutes is the correct amount of child support to be awarded.
