How is the amount of spousal support determined?
The decision whether to award one party spousal support can be agreed to by the parties or ordered by the Court. Spousal support may be awarded by the Court upon the entry of a decree providing for the dissolution of a marriage, for a divorce, that neither party is entitled to a divorce, or for separate maintenance.
When determining whether to grant spousal support to a spouse, the Court shall consider the circumstances and factors which lead to the breakdown of the marriage, especially if one party was responsible for the fault grounds for divorce—adultery, cruelty, reasonable apprehension of bodily hurt, or willful desertion or abandonment.
